In November, 2016, U.S. Citizens and Immigration Services (USCIS) issued a revised Form I-9, the form used to verify employee identity and authorization to work in the United States.  Among the changes on the new form are revised questions regarding employee names in Section 1, the inclusion of “prompts” to reduce errors and facilitate correct completion of the form, and a dedicated area (other than the margins) for including additional information.  USCIS also took steps to make the form easier to complete on a computer.  Retention and storage requirements for Forms I-9 remain unchanged.

Employers may download the new form here:  Form I-9, Employment Eligibility Verification.  During the transition from the old form, which bears a revision date of 03/08/13 N, employers could continue to use the old form or implement the new one.  Starting on January 22, 2017, employers are required to use the updated form.  To avoid potential penalties, employers should ensure that they are using the correct form, which bears a revision date of 11/14/2016 N and an expiration date of 08/31/2019.
