Deschutes County braces for rise in foreclosures

Judges in Deschutes County are bracing for a sharp uptick in foreclosures as banks skip the non-judicial foreclosure process following a new state law.

The circuit court scheduled 323 initial foreclosure hearings between January and September, more than double the hearings scheduled for all of last year and six times the number from 2010. Court officials say more trials on contested foreclosures could mean less time for the seven judges to hear other cases.

The banks have been avoiding non-judicial foreclosures because of the state's new foreclosure mediation law and an Oregon Court of Appeals ruling against lenders that use an electronic database to record mortgage transfers.
