Judge rules on marijuana initiative

A Marion County judge ruled that Secretary of State Kate Brown acted properly when she decided a marijuana legalization measure didn't have enough signatures for the November ballot.

Marion County Circuit Judge Mary Mertens James said Brown operated within the broad scope of the authority given her by the Legislature when she invalidated signatures that were duplicates, illegible or from people not registered to vote.

"The Secretary is not obligated to achieve complete specificity through rule making," James wrote in her decision, "when she has exercised her statutory responsibility to make rules, implement step-by-step procedures and carry out legal authority found everywhere else, to validate signatures pursuant" to state law.

Another marijuana legalization measure has qualified for the November ballot and is not affected by this ruling.
