Bend loses tax fight

A special tax on downtown property owners was at the center of the city of Bend's three-year dispute.

The original suit was filed by five downtown property owners and argued that the tax was improperly created. The latest decision leaves open questions. The city, for example, isn’t sure what it can do with money raised by the tax. But the ruling appears to be limited to just the original district, not others created since...

The Oregon Court of Appeals on Wednesday filed a decision that upheld one by Deschutes County Circuit Court Judge Stephen Tiktin. Lawyers on both sides of the case say the decision refers only to the economic improvement district, or EID, the city created in 2005.
